Terms of Service

1. Acceptance of Terms

By accessing or using the website at terryhealthclinic.com, scheduling appointments, or receiving services from TerryHealth LLC ("TerryHealth," "we," "us," or "our"), you ("patient," "user," or "you") agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our services.

2. Description of Services

TerryHealth LLC is a direct-pay telehealth practice providing primary care and family medicine services through secure video consultations. Services are provided by Teresa Vazquez, FNP-BC, a board-certified Family Nurse Practitioner licensed in the state of Florida.

Our services include but are not limited to:

• Telehealth consultations via secure video platform
• Chronic disease management and monitoring
• Acute illness evaluation and treatment
• Prescription management and medication refills
• Lab order coordination and result review
• Preventive care and wellness consultations
• Secure patient portal messaging

3. Eligibility Requirements

To use TerryHealth services, you must:

• Be physically located in the state of Florida at the time of each telehealth visit
• Not have active health insurance (TerryHealth is a direct-pay practice)
• Be at least 7 years of age (patients under 18 must have parent/guardian consent)
• Provide a valid government-issued photo ID
• Have access to a device with internet connectivity, camera, and microphone
• Provide accurate and complete health information

TerryHealth reserves the right to decline or discontinue services to any patient who does not meet eligibility requirements or whose medical needs exceed the scope of our telehealth practice.

4. Payment and Billing

Direct-Pay Model

TerryHealth LLC is a direct-pay practice. We do not bill insurance companies. All fees are the responsibility of the patient and must be paid directly to TerryHealth LLC.

Prepayment Requirement

Except for the initial free consultation, all visits require prepayment. Your credit or debit card on file will be automatically charged 4 hours before your scheduled appointment. By maintaining a card on file, you authorize TerryHealth to charge your card for scheduled services.

Visit Fees

• New Patient Consultation: $0 (Free)
• New Patient Evaluation: $100
• Follow-up Visit: $50
• Acute/Sick Visit: $75
• Chronic Disease Management: $85
• Senior Adult Visit: $109
• Child Add-On: $35

5. Membership Plans

TerryHealth offers monthly membership plans billed on a recurring basis:

• Individual Basic — $89/month: 2 follow-up visits
• Individual Standard — $129/month: 3 follow-up visits + 1 sick visit
• Senior Individual — $149/month: 4 senior visits + 1 sick visit
• Family Basic — $199/month: Up to 4 members, 4 shared visits + 1 sick visit
• Family Standard — $299/month: Up to 4 members, 8 shared visits + 2 sick visits

Membership visits do not roll over to the following month. Unused visits expire at the end of each billing cycle. All membership plans include secure portal messaging with responses within 24–48 business hours.

6. Cancellation and Refund Policy

Appointment Cancellations

Appointments must be cancelled at least 48 hours before the scheduled time to avoid charges. Cancellations made less than 48 hours before the appointment may not be eligible for a refund, as payment is collected 4 hours prior to the visit.

Membership Cancellations

Monthly membership plans may be cancelled at any time with 30 days written notice through the patient portal. To cancel, send a secure message through your patient portal at terryhealthclinic.com. Membership benefits continue through the end of the paid billing period.

Refunds

Refunds are considered on a case-by-case basis at the sole discretion of TerryHealth LLC. Technical failures attributable to TerryHealth that prevent a completed visit may qualify for a refund or appointment credit.

7. Telehealth Terms

By using our telehealth services, you acknowledge and agree that:

• You are physically located in Florida at the time of each visit
• Telehealth has inherent limitations compared to in-person care
• Some conditions may require in-person evaluation or emergency care
• You are responsible for being in a private, secure location during visits
• You will not record video sessions without prior written consent from TerryHealth
• TerryHealth uses CharmHealth's HIPAA-compliant Charm Integrated Video platform
• In the event of technical failure, you agree to contact us via the patient portal
• For medical emergencies, you must call 911 or go to the nearest emergency room immediately

8. SMS Communications

By providing your mobile phone number and consenting to SMS communications, you agree to receive text messages from TerryHealth LLC for appointment reminders, billing notifications, and healthcare communications. Message and data rates may apply. Reply STOP to opt out. Reply HELP for assistance. See our Privacy Policy for full SMS terms.

9. Patient Responsibilities

As a TerryHealth patient, you agree to:

• Provide accurate and complete health information
• Keep your contact and payment information current
• Attend scheduled appointments or cancel with adequate notice
• Use the patient portal for non-emergency communications
• Contact emergency services (911) for medical emergencies
• Maintain the confidentiality of your patient portal login credentials
• Upload a valid government-issued photo ID before your first visit
• Complete required intake forms and consent documents before visits

10. Limitations of Service

TerryHealth LLC does not provide:

• Emergency medical services — call 911 for emergencies
• Psychiatric or mental health treatment (beyond screening)
• In-person examinations or procedures
• Services to patients outside Florida
• Services to patients with active health insurance
• Specialist care (we provide referrals as appropriate)
• Workers' compensation evaluations

11. Disclaimer and Limitation of Liability

TerryHealth LLC provides telehealth services to the best of our ability within the scope of nurse practitioner practice in Florida. However, no medical outcomes can be guaranteed. TerryHealth LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services.

Our total liability to any patient for any claim shall not exceed the amount paid by that patient for services in the three months preceding the claim.

12. Privacy

Our collection and use of personal and health information is governed by our Privacy Policy and HIPAA Notice of Privacy Practices, both incorporated herein by reference.

13. Governing Law

These Terms of Service are governed by the laws of the State of Florida. Any disputes arising from these terms shall be resolved in the courts of Miami-Dade County, Florida.

14. Changes to Terms

TerryHealth LLC reserves the right to update these Terms of Service at any time. Material changes will be communicated to active patients through the patient portal. Continued use of our services after changes constitutes acceptance of the updated terms.
